Terms of Service

Effective 6 September 2026. Last updated 6 September 2026. Includes the game licence (EULA).

The short version.

  • You may play the game, and you may not resell it or pull it apart and ship the pieces.
  • Anything you build, you own. Publishing it gives us permission to host and show it, not to take it.
  • Scrip is points. It is not money and it never converts to money.
  • Do not upload things that are not yours, and do not upload things that hurt people.
  • We are a very small company. The liability section is short and it is real.

The rest of this page is the detail behind those five lines.

1. This agreement

These terms are between you and Seedling Systems LLC (“we”, “us”), a limited liability company registered in Hawaii, United States. They cover the S.M.A.S.H. Co. game on every platform we ship it, and the smashco.net website including the creator editors, the marketplace and the leaderboards.

By installing, playing, or creating an account, you accept these terms. If you do not accept them, do not use the service.

If you bought the game on Steam, Valve’s Steam Subscriber Agreement also applies to that purchase, and Valve handles refunds under its own policy. Where Valve’s terms govern the transaction and ours govern the game itself, both apply to their own part.

2. Who can use it

You must be at least 13 years old to create an account. If you are under the age of majority where you live, you need a parent or guardian’s permission, and they accept these terms with you.

3. Your account

You do not need an account to play. You need one to sync progress, publish content, or appear on a leaderboard.

  • Give us a real email address — it is how we reach you about your account and how you recover it.
  • Keep your password to yourself. You are responsible for what happens under your account.
  • One person per account. Do not share, sell or transfer it.
  • Tell us at support@smashco.net if you think someone else is in it.

You can delete your account at any time. See the Privacy Policy for exactly what that removes.

4. The game licence (EULA)

This section is the End User Licence Agreement for the game itself.

4.1 What you get. When you obtain a copy of the game legitimately, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and play it on devices you control, for your own non-commercial entertainment.

4.2 What you do not get. The game is licensed, not sold. We and our licensors keep all ownership of the game, its code, art, audio, writing, characters and brand. Nothing here transfers any of that to you.

4.3 What you may not do. You may not:

  • sell, rent, sublicense or redistribute the game or any part of it;
  • reverse-engineer, decompile or disassemble it, except exactly as much as the law where you live says you are entitled to regardless of this clause;
  • strip out or reuse its assets — art, audio, models, text — in another project;
  • circumvent, disable or work around any licensing, purchase or anti-cheat mechanism;
  • use it to break the law, or to harass anyone.

4.4 Things we explicitly allow. Because it is worth being clear rather than silent:

  • Streaming and video. Stream it, record it, put it on any platform, and monetise those videos. You do not need our permission and you do not owe us a share. Just do not upload the game itself.
  • Screenshots and clips in reviews, articles and social posts — go ahead.
  • Building content with the in-game and web editors, and sharing it through our marketplace. That is the point of them. See section 5.

4.5 Ending the licence. The licence ends if you materially break these terms. We will normally warn you first unless the breach is serious or repeated. If we end it, stop using the game and delete your copies.

5. Content you create

You own what you make. Building a level, prefab, effect or pack does not give us ownership of it, and nothing in this section takes your copyright away.

5.1 The licence you give us. To host your work and show it to other players, we need your permission. By publishing content to the marketplace or otherwise making it public, you grant us a non-exclusive, worldwide, royalty-free licence to store, reproduce, adapt for technical purposes (format conversion, compression, generating thumbnails), publicly display and distribute that content, and to feature it in screenshots, trailers and other promotional material for the game.

This licence exists so the service can function and so we can show off what people build. It is not exclusive — you can publish the same work anywhere else, sell it elsewhere, or build a business on it. We do not take a share of anything you do with it outside our marketplace.

5.2 What this licence does not include. We will not sell your content as our own product, and we will not fold a community pack into shipped official game content without asking you first and crediting you. If we ever want to do that, it is a separate conversation and a separate yes.

5.3 Unpublishing. You can unpublish your content at any time, and we will remove it from the marketplace. Two honest caveats: copies already downloaded by other players stay on their devices, and we may keep a copy in backups for a limited period before those rotate out. We cannot reach into somebody else’s installation, and we would rather say so than imply a delete button is more powerful than it is.

5.4 What you promise us. When you publish something you are telling us that it is yours to publish — that you made it, or you have the rights to it, and that it does not infringe anyone’s copyright, trademark or privacy.

5.5 What you must not publish.

  • Anything you do not have the rights to — including ripped assets from other games.
  • Anything that sexualises minors. This gets you permanently removed and reported, with no warning and no appeal.
  • Content that harasses, threatens or targets a real person, or that promotes hatred against people for who they are.
  • Malware, or anything designed to break the game or other players’ installations.
  • Spam, scams, or content that exists only to game the scrip or ranking systems.
  • Real-world religious symbols and imagery, which we keep out of this game entirely as a matter of house style.

5.6 Moderation. We review submissions before they reach the public catalog, and we can remove anything that breaks 5.5 or that we reasonably believe is unlawful. We will tell you why. If you think we got it wrong, reply and a human will look again — we would rather fix a bad call than defend it.

5.7 Copyright complaints. If something on our service infringes your copyright, email support@smashco.net with enough detail to identify the work and where it is, and a statement that you are the rights holder or authorised to act for them. We will investigate and remove infringing material. If your content was removed and you believe it was in error, tell us and we will restore it if you are right.

6. Scrip and in-game currency

Scrip is a scoring and reward mechanism inside the game. To be completely unambiguous:

  • Scrip is not money and has no cash value.
  • It cannot be exchanged for money, transferred between accounts, or sold.
  • You do not own it — it is a licence to use a feature of the game.
  • We may adjust how it is earned and spent as we balance the game.
  • It disappears when your account does.

Content packs are free. There is no paid user content at this time. If we introduce it later, that will come with its own creator agreement setting out revenue share, payouts and tax handling, and we will not apply it to anything retroactively without your agreement.

7. Fair play

Do not:

  • submit fake, manipulated or automated leaderboard scores;
  • use bots, scripts or modified clients to farm scrip or rankings;
  • attack, overload or probe our servers, or try to reach data that is not yours;
  • scrape the service, or use it to train a machine-learning model on other people’s content without their permission;
  • impersonate us or another player.

We remove implausible leaderboard entries automatically and by hand. Repeated or deliberate cheating costs you the account.

8. The service can change

We are actively developing this game. Features will be added, changed and sometimes removed. Online services — sync, marketplace, leaderboards — may be interrupted for maintenance, and will not run forever.

If we shut the online services down, we will give at least 90 days’ notice where we are able to, and provide a way to export your saves and everything you have created before they go. Single-player play from a copy you already own will not be remotely disabled.

9. Warranty

The service is provided “as is”. We do not promise it will be uninterrupted, error-free, or that it will run on any particular hardware. To the fullest extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Some jurisdictions do not allow those disclaimers, and consumer law where you live may give you rights that this section cannot take away. Nothing here limits those rights.

10. Liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost data, lost profits, or lost progress.

Our total liability to you for any claim relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim, or fifty US dollars.

Nothing in this section limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not permit us to limit.

11. Ending it

You can stop using the service and delete your account whenever you like.

We can suspend or close your account if you materially break these terms. Except for serious cases — illegal content, attacks on the service, content covered by the second bullet of 5.5 — we will tell you what the problem is and give you a chance to fix it first.

12. Governing law

These terms are governed by the laws of the State of Hawaii, United States, without regard to its conflict-of-law rules, and the state and federal courts located in Hawaii have jurisdiction.

If you are a consumer in the EU, the UK, or another jurisdiction whose law gives you the right to bring proceedings locally and to the protection of your own consumer law, this clause does not remove that right.

13. Changes to these terms

We will update the date at the top when these change. For material changes we will give notice on the site and in the game before they take effect. If you keep using the service after that, you accept the new terms; if you do not accept them, close your account and we will help you export your data first.

14. The rest

If one part of these terms turns out to be unenforceable, the rest still stands. Not enforcing something once does not mean we have given it up. These terms, together with the Privacy Policy, are the whole agreement between us about the service. You may not assign them; we may, to a successor of the business, and we will tell you if that happens.
